STATUTORY BENEFIT FRAMEWORK

How Pennsylvania Calculates Workers' Comp Benefits

Statutory Rate66.67%
Max Weekly Benefit$1,262
Min Weekly Floor$50
Waiting Period7 days

In Pennsylvania, workers' compensation benefits are established under the Pennsylvania Workers' Compensation Act (PA WC Act § 306, 77 P.S. § 511–513) and administered by the Pennsylvania Department of Labor and Industry (DLI), Bureau of Workers' Compensation.

When an employee experiences total disability resulting from a work-related injury, they are eligible for Temporary Total Disability (TTD) compensation. Under PA WC Act § 306(a), benefits generally equal 66 2/3% (66.67%) of the injured worker's Average Weekly Wage (AWW). The AWW is computed using wages from the four consecutive quarters preceding the injury.

For injuries occurring in calendar year 2024, the Pennsylvania maximum weekly compensation rate is $1,262.00, and the minimum weekly benefit floor is $50.00 (or 90% of AWW for low-wage earners, subject to statutory sliding tiers). Pennsylvania requires a 7-day waiting period; wage-loss compensation is not paid for the first 7 calendar days unless disability extends to 14 days or more, at which point benefits are paid retroactively.

Duration and IRE Review: In this calculator, 104 weeks is utilized as an administrative benchmark. Under Pennsylvania law (77 P.S. § 511.3 / Act 111), an insurer may request an Impairment Rating Evaluation (IRE) after an employee has received 104 weeks of total disability. The 104-week threshold is an evaluation checkpoint rather than an automatic termination of benefits. If the IRE results in a whole-body impairment rating of 35% or greater, total disability continues; if the rating is below 35%, benefits transition to partial disability, which is capped at 500 weeks. Specific loss benefits under 77 P.S. § 513 provide scheduled healing periods for anatomical loss.

Important Limitations: This calculator provides educational temporary wage-replacement estimates. It does not predict IRE physician evaluations, specific loss awards, or Compromise and Release (C&R) settlement agreements.
